This session will present an overview of issues patent relevant to medical technology and will include some general information that is relevant to specification and claim drafting, patentable subject matter, infringement and enforcement of medical patents. Some of these same topics will be covered in more detail in Sessions 2-4 as they relate to specific technology areas.

Medical Technology: Chemical & Biotechnology9:30 AM - 11:00 AM

This session will present issues unique to the chemical and biotech arts in medical technology. Specifically, the session will include case studies and practical suggestions for overcoming subject matter eligibility, enablement, and written description issues. Other topics to be discussed will include case law on the obviousness of medical technology patents. This session will NOT cover inventions relating solely to pharmaceutical products.

Electronics & Imaging Inventions9:30 AM - 11:00 AM

This session will present issues unique to the electronic and imaging arts in medical technology. Specifically, the session will include case studies on functional claiming and subject matter eligibility, and discuss strategies to avoid/overcome 35 U.S.C. §112(f) claim interpretation and 35 U.S.C. §101 rejections. Other topics to be discussed  will  include  case  law  addressing the obviousness of claims directed to medical technology.

Mechanical Inventions9:30 AM - 11:00 AM

This session will present issues unique to mechanical inventions in medical technology. Specically, the session will include case studies on functional claiming, definiteness, and subject matter eligibility, and discuss strategies to avoid/overcome 35 U.S.C.§112(f) claim interpretation, 35 U.S.C. 112(b), and 35 U.S.C. §101 rejections. Other topics to be discussed will include claim drafting tips, printed matter on a medical device and claiming use of a medical device.
